How would amnesia affect the prosecution of a criminal?

I am writing a story for creative writing about a criminal who loses his memory. Essentially he and his associates had robbed a bank, but crashed while escaping the crime and the main character loses all memory of who he is. Are there any technicalities that would reasonably affect his trial? Is it possible that his trial might be extended so that he may attend some form of counseling in order to get his memory back, and in the mean time he is allowed to go about his normal life? Any help would be appreciated.How would amnesia affect the prosecution of a criminal?
If there is evidence to put him on trial his amnesia would not prevent him from being prosecuted. And it is no defense. However, it is possible that there could be a delay to have him examined to see if he is mentally competent to stand trial or just plain crazy.

Good idea. This has possibilities for a good read or movie. I can see his agony to remember during the trial only to recall the truth that he is innocent later...How would amnesia affect the prosecution of a criminal?
